General terms and conditions of business

1. SCOPE
These General Terms and Conditions (GTC) apply to all deliveries from Henrix Guitars – Henrik Michalzik (www.henrixguitars.de) to consumers.
A consumer is any natural person who concludes a legal transaction for a purpose that cannot predominantly be attributed to either their commercial or independent professional activity.

2. CONTRACTUAL PARTNERS
The purchase contract is concluded with the online shop www.henrixguitars.de, owner: Henrix Guitars – Henrik Michalzik, Hannoversche Str. 26, 29690 Lindwedel (Germany)

3. CONCLUSION OF CONTRACT
The presentation of the products in the online shop does not constitute a legally binding offer, but rather only an invitation to order.
By clicking the “No obligation request” button, you submit a non-binding order request for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation via email after receiving your order.

4. RIGHT OF WITHDRAWAL
If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.
If you as a consumer exercise your right of withdrawal, you will have to bear the regular return shipping costs.
Otherwise, the regulations that are set out in detail in the following apply to the right of withdrawal:

4.1 CANCELLATION POLICY
You can cancel your order within two weeks without giving reasons in text form (e.g. by letter, fax, email), by telephone or by returning the goods. The buyer pays the return shipping. The period begins at the earliest upon receipt of this instruction. To meet the cancellation deadline, it is sufficient to send the cancellation or the goods on time.

The purchase contract will be canceled after the goods are returned and we will repay any payments already made by bank transfer within 14 days.
In the event of a return, the consumer must bear the costs of the return if the goods delivered correspond to those ordered.
Costs paid by the customer for telephone order acceptance, flat-rate shipping costs and cash on delivery fees will not be reimbursed unless the goods delivered do not correspond to those ordered. In the event of an exchange due to your incorrect order, we will charge you for re-shipment.
If the goods show signs of use or damage when they are returned, Henrix Guitars – Henrik Michalzik reserves the right to assert claims for compensation.

4.2 CONSEQUENCES OF CANCELLATION
If you cancel this contract, we will refund to you all payments received from you, including delivery costs (except for additional costs resulting from you choosing a method of delivery other than the cheapest standard delivery offered by us have) to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired.
You bear the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

5. PRICES & TAXES
According to Section 19 UstG, no sales tax is charged.

6. SHIPPING COSTS & DELIVERY
Shipping fees and any applicable import fees and taxes/customs are to be borne by the buyer. The amount of shipping costs depends individually on the delivery area. The exact costs will be communicated during the offer processing before the order is placed.

7. PAYMENT
Advance payment (bank transfer) – For instruments that are immediately available
After we receive your order, I will check your order and send you the necessary payment information. As soon as I have received the payment amount, I will ship your new Henrix Guitar/Bass to you.

Payment in advance (bank transfer) – for custom-made items
After all the details have been discussed, I will invoice you for a deposit amounting to 50% of the order value. The deposit amount is non-refundable due to the cost of materials. After receiving the deposit, I will start producing your personal Henrix Guitar/Bass. The remaining balance is due upon completion of the instrument. After receiving the final payment, I will ship your order immediately. The guitar remains my property until full payment is made.

8. RETENTION OF TITLE
The goods remain our property until full payment has been made.
